The constitutional framework of the agricultural system and the real estate management policy in Poland
Abstract
Rozprawa obejmuje pojęcia służące kształtowaniu ustroju rolnego mające swoje źródło w Konstytucji RP. Analizie i systematyzacji zostaje poddane pojęcie gospodarstwa rolnego, służącemu na jego korzyść ustroju rolnego, opartego na orzecznictwie Trybunału Konstytucyjnego i doktrynię Wysunięty został postulat w zakresie wyraźnego określenia pozycji prawnej Konstytucji RP w kontekście ustroju rolnego. W kolejnych częściach rozprawy omówione zostają mechanizmy służące wspieraniu przez państwo podstawowej jednostki ustroju rolnego, jakim jest gospodarstwo rodzinne oraz warunków preferencyjnych, którymi ono dysponuje. Rozprawa składa się z wstępu, zakończenia oraz czterech rozdziałów. W pierwszej kolejności analizie poddano konstytucyjne ramy ustroju rolnego państwa. Badaniu podlegał kształt i istota wizji ustroju rolnego koncentrującego nacisk na szeroko rozumianej polityce rolnej, jej normatywnym kierunku i rozwoju, poprzez mechanizmy centralizacji systemu gospodarowania gospodarką rolną państwa. W dalszej części poświęcono uwagę determinantom kreującym i wspierającym ustrój rolny państwa takim jak determinanty polityczne, ekonomiczne i społeczne. Szczegółowej analizie poddano pojęcie Zasobu, jako podstawy systemu wspierającego funkcjonowanie polityki rolnej państwa, a także rodzajom kryteriów służących klasyfikacji nieruchomości. Poddano szczegółowej analizie podstawowe zasady prawne gospodarowania Zasobem Własności Rolnej Skarbu Państwa, a także omówiono instytucję Krajowego Ośrodka Wsparcia Rolnictwa jako instytucjonalnego instrumentu kreowania polityki rolnej państwa. Na tym tle zwrócono szczególną uwagę na formy zagospodarowania gruntów rolnych Skarbu Państwa takie jak sprzedaż, dzierżawa, nieodpłatne przekazanie, przekazanie aportem do spółek, czy też inne. W dalszej kolejności przystąpiono do omówienia gospodarstwa rodzinnego jakom przedmiotu polityki rolnej państwa, w kontekście uprawnień państwa w postaci prawa pierwokupu czy prawa odkupu, a także doprecyzowania znaczenia przepisów nadających Krajowemu Ośrodkowi Wsparcia Rolnictwa powyższe uprawnienia. Rozprawę kończą rozważania dotyczące polityki państwa w zakresie obrotu nieruchomościami rolnymi z udziałem cudzoziemców w świetle historycznym, programowym i prawnym. Omówiono także rolę i znaczenie gospodarstw rodzinnych w państwach Unii Europejskiej.
The dissertation covers the concepts used to build the agricultural system, which have their source in the Constitution of the Republic of Poland. The concept of an agricultural holding, serving in his favor the agricultural system based on the jurisprudence of the Constitutional Tribunal and the doctrine, is subject to analysis and systematization. The following parts of the dissertation discuss the mechanisms used by the state to support the basic unit of the agricultural system, which is the family farm, and the preferential conditions that it has at its disposal. The dissertation consists of an introduction, conclusion and four chapters. First, the constitutional framework of the agricultural system of the state was analyzed. The study focused on the shape and essence of the vision of the agricultural system focusing on the broadly understood agricultural policy, its normative direction and development, through the mechanisms of centralization of the state agricultural management system. In the following part, attention is paid to the determinants that create and support the agricultural system of the state, such as political, economic and social determinants. The concept of Stock as the basis of the system supporting the functioning of the agricultural policy of the state was subjected to a detailed analysis, as well as the types of criteria used to classify real estate. The basic legal principles of managing the Agricultural Property Stock of the State Treasury were subjected to a detailed analysis, and the institution of the National Support Center for Agriculture as an institutional instrument for creating the agricultural policy of the state was discussed. Against this background, particular attention was paid to the forms of development of agricultural land owned by the State Treasury, such as sale, lease, gratuitous transfer, transfer in kind to companies, or others. Next, the family farm was discussed as the subject of the state agricultural policy, in the context of the powers in the form of the right of pre-emption or repurchase right, as well as the clarification of the meaning of the provisions granting the National Center for Agriculture Support the above powers. The dissertation ends with considerations on the state policy in the field of agricultural real estate trading with the participation of foreigners in the historical, program and legal light. The role and importance of family farms in the European Union countries are discussed.
