Abstract

Rozprawa doktorska dotyczy procedur specjalnych Rady Praw Człowieka, które uznawane są za filar ONZ-owskiego systemu ochrony praw człowieka. Analiza obejmuje przede wszystkim mandaty tematyczne procedur specjalnych. Celem rozprawy jest określenie zdolności procedur specjalnych do wywierania wpływu na przestrzegania praw człowieka, zarówno w wymiarze indywidualnym jak i instytucjonalnym. Służy temu analiza statusu piastunów mandatów, ich zadań i metod działania. W rozprawie podjęto próbę zidentyfikowania i oceny czynników wzmacniających i osłabiających wpływ procedur specjalnych. Wnioski z przeprowadzonych badań wskazują, że procedury specjalne zdolne są do wywierania bezpośredniego oraz pośredniego wpływu na kondycję praw człowieka. Wpływ ten jest jednak ograniczony, głównie ze względu na brak współpracy ze strony państw oraz brak odpowiednich środków na działanie mechanizmu. W rozprawie przedstawiono postulaty zmian, których wprowadzenie pozwoliłoby na wzmocnienie wpływu procedur specjalnych. The doctoral dissertation examines the special procedures of the UN Human Rights Council, which are considered to be a pillar of the UN human rights protection system. The analysis focuses on thematic mandates of special procedures. The aim of this dissertation is to determine the potential of special procedures to have an impact on respecting human rights, both on an institutional and individual level. For this purpose, the status of mandate-holders, their tasks and working methods are examined. The dissertation attempts to identify and assess the factors strengthening and weakening the special procedures’ impact. The research conclusions reveal that the special procedures are capable of having an direct and indirect impact on human rights. However, the impact is limited, primarily by the lack of cooperation by states and the lack of adequate resources. The dissertation discusses the main challenges faced by special procedures and the steps that should be taken to address them.
