The Freedom of Artistic Expression in Poland after 1989
Abstract
W rozdziale pierwszym scharakteryzowane zostały kluczowe dla wolności wypowiedzi przepisy konstytucyjne oraz karne, a także orzecznictwo trybunału w Strasburgu. Krytycznej rewizji został poddany również immunitet sztuki na obszarze prawa, czyli tzw. kontratyp sztuki. W rozdziale drugim prześledzone zostało kształtowanie się zjawiska immunitetu artysty i sztuki na przestrzeni dziejów. W analizie posłużono się narzędziami dostarczonymi przez Anthony’ego Juliusa, który wyznaczył typy obrony służące utwierdzaniu specjalnego społecznego i prawnego statusu artysty. Rozdział trzeci jest przedstawieniem dziejów cenzury w sztuce polskiej po 1989 r. Na podstawie zgromadzonego materiału faktograficznego zostały wychwycone charakterystyczne, jakościowe i ilościowe cechy badanego w czasie zjawiska. Towarzyszy temu detaliczna analiza dyskursu medialnego opartego głównie na publikacjach „Gazety Wyborczej”. Rozdział czwarty jest rozbudowaną analizą sprawy Doroty Nieznalskiej – artystki oskarżonej w 2003 r. o obrazę uczuć religijnych. Zbadane zostały w nim korzenie konfliktu, przeanalizowana recepcja medialna ponad ośmioletniego postępowania sądowego, typy obrony artystki oraz niemający w Polsce precedensu proces.
In the first chapter constitutional and legal regulations limiting the freedom of artistic expression are described (including the judgments of The European Court of Human Rights). Moreover, it contains a critical review of the notion of a legal immunity of art. The second chapter discusses the historical formation of the immunity of art. Different types of rhetoric art defense (pointed out by Anthony Julius), which are used in the legal and social discourse to enhance artistic prerogatives, were adopted for the sake of analysis. Chapter three shows the history of censorship in the Polish art since 1989. Based on the factual material taken form the media (press and the Internet mainly), it attempts to distinguish the qualitative and quantitative features of the examined phenomenon, as well as its dynamics. In the last, fourth chapter, the case of Dorota Nieznalska (an artist charged in 2003 with offence of religious feelings) is examined, starting from the roots of the conflict, through the media feedback on the 8 year criminal case (especially the types of defense of the artist), ending with the detailed analysis of the criminal procedure and court judgments.
