Family in the Polish Law on Foreigners. A Study in Administrative Law
Abstract
Rozprawa podejmuje temat wartości rodziny w polskim prawie regulującym wjazd, pobyt i wyjazd cudzoziemców. Rozważania koncentrują się wokół czterech tez. Po pierwsze, status prawny cudzoziemca w powiązaniach rodzinnych wyróżnia się na tle statusu prawnego ogółu cudzoziemców. Po drugie, status ten nie jest jednorodny, lecz podlega modyfikacjom, w znacznej mierze zależnym od rodzaju powiązań oraz obywatelstwa zainteresowanych. Po trzecie, znaczenie powiązań rodzinnych nie jest identyczne na poszczególnych etapach kontaktu cudzoziemca z terytorium Polski. Po czwarte, regulacje prawne kształtujące status cudzoziemca w powiązaniach rodzinnych nastręczają licznych problemów w procesie stosowania prawa. Podstawową metodą wykorzystaną w rozprawie jest analiza przepisów prawa o cudzoziemcach oraz omówienie sposobu ich stosowania w sprawach, do których osnowy należy fakt pozostawania cudzoziemca w powiązaniach rodzinnych. Pierwsza część rozprawy poświęcona jest wyjaśnieniu podstawowej terminologii, w drugiej zaprezentowane zostało normatywne ujęcie statusu cudzoziemca w powiązaniach rodzinnych, zaś ostatnia dotyczy wybranych zagadnień stosowania prawa w omawianej dziedzinie. W zakończeniu wskazuje się, że wartość rodziny została uwzględniona przez ustawodawcę, jednak dla jej urzeczywistnienia potrzebne jest przykładanie większej wagi do procesu stosowania prawa.
The dissertation refers to the value of family in the Polish law governing entry, stay and departure of foreigners. It focuses on four research thesis. Firstly, the legal status of foreigners in family relationships is distinguishable from the status of other foreigners. Secondly, this status is not homogenous. It is subject to modifications depending mainly on the type of relationships and the nationality of the persons involved. Thirdly, the extent to which foreigners' family relationships are taken into account is not identical on different stages of their contact with the territory of Poland. Forthly, the regulations concerning foreigners in family relationships cause numerous problems in the process of their application. The main method used in the dissertation is careful scrutiny of the Polish law on foreigners followed by the presentation of the way they are applyied in cases concerning foreigners in family relationships. The first part of the dissertation is dedicated to the explanation of basic terminology, in the second part the legal status of foreigners in family relationships is described, and the last one deals with selected issues of the application of the law from the foreigner's family life perspective. In conclusion, it is argued that the value of family is important for the legislator but its practical realisation still requires more consideration.
