The Child Welfare and the interests of other persons in the Polish legal regulation of adoption
Abstract
Celem niniejszej rozprawy jest analiza relacji między dobrem dziecka a interesami rodziców dziecka oraz przysposabiających. Zgodnie z główną tezą rozprawy bardzo trudne jest utrzymanie odpowiedniej równowagi między interesami tych podmiotów. Z jednej strony nie zapewnia się wystarczającej ochrony małoletniemu tam, gdzie jest to niezbędne, z drugiej zaś strony absolutyzuje się dobro przysposobionego w nielicznych przypadkach, gdy konieczne jest uwzględnienie również interesów innych podmiotów. Ponadto, ustawodawca nie zawsze rozstrzyga prawidłowo konflikt interesów między rodzicami a przysposabiającymi.
The purpose of this doctoral dissertation is to analyse relations between three parties of the adoption triangle – adoptive parents, an adopted child and their biological parents. The main thesis of this PhD dissertation is that it is really difficult to keep the balance between the three adoption parties’ interests in a proper way. On the one hand, the Polish legal regulations do not take child’s welfare into consideration in these areas where it is necessary. On the other hand, sometimes the legislator does not notice the interests of other parties, when it is desirable. It is worth pointing out that sometimes the conflict of interests between biological parents and adoptive parents is not solved in the way as it should be.
