Ograniczenie praw jednostki przez zastosowanie przymusu bezpośredniego w celu zapewnienia bezpieczeństwa i porządku publicznego

Abstract

Państwo, odpowiedzialne za zapewnienie ochrony praw i wolności jednostek, wyposażone jest w różnego rodzaju środki, mające na celu przeciwdziałanie naruszeniom. Jednym z najbardziej dolegliwych uprawnień jest możliwość zastosowania przymusu bezpośredniego. Uprawnienie to przysługuje głównie upoważnionym osobom, działających w imieniu organów, w których pełnią służbę lub są zatrudnione. Państwo ma monopol na stosowanie przymusu bezpośredniego i dysponowanie tym uprawnieniem. W obowiązującym systemie prawnym funkcjonuje wiele aktów prawnych regulujących kwestie zastosowania przymusu bezpośredniego. Zgrupować je można w obszary ze względu na cel zastosowania przymusu: w celach leczniczych, wychowawczych, zapewnienia prawidłowego toku postępowania oraz zapewnienie bezpieczeństwa i porządku publicznego. Rozprawa dotyczy ostatniego z wymienionych obszarów. Prawo reguluje w jakich przypadkach, kto i w jaki sposób może zastosować środki przymusu bezpośredniego. Każdorazowe ich użycie ma bezpośredni wpływ na poszczególne prawa i wolności jednostki – co stanowi przedmiot badań niniejszej pracy. Za niezgodne z prawem zastosowanie tych środków grozi odpowiedzialność dyscyplinarna, karna i cywilna, a jednostkom, których prawa zostały naruszone, przysługuje możliwość dochodzenia swoich roszczeń w ramach różnych środków ochrony praw i wolności.

A country, responsible for ensuring protection of rights and freedoms of individuals, uses different types of measures necessary to prevent any breaches. One of the most problematic rights is the entitlement to use coercive measures. This right is vested mainly in authorised persons, acting on behalf of authorities, who serve or are employed therewith. The country has the exclusive right to take coercive measures and dispose of the said right. There are many legal acts governing issues related to the entitlement to use coercive measures, which are in force in the existing legal system. They can be categorised into areas by the purposes of taking coercive measures: for medical treatment, education, maintenance of a proper course of action and provision of safety and public order. The thesis concerns the last of the areas mentioned. The law regulates in which cases, who and how coercive measures can be taken. Each use has a direct influence on specific rights and freedoms of individuals – which is the subject matter of this paper. Unlawful use of those measures may result in disciplinary, criminal and civil liability. Persons whose rights have been violated are entitled to pursue their claims by taking different right and freedom protection measures.
