PROCEEDINGS IN THE CONSUMER BANKRUPTCY DECLARATION

Abstract

Artykuł przedstawia problematykę przebiegu postępowania sądowego w przedmiocie ogłoszenia upadłości konsumenckiej – pierwszego etapu postępowania upadłościowego porównawczo odnosząc ją do zwykłego postępowania upadłościowego. Wskazuje się, że postępowanie dotyczące upadłości osób fizycznych wszczynane jest wyłącznie na wniosek dłużnika, a złożenie wniosku nie jest uzależnione od daty powstania stanu niewypłacalności. Z uwagi na fakt, że postępowanie w upadłości konsumenckiej obejmuje wyłącznie likwidację majątku, składający wniosek nie musi określać sposobu prowadzenia upadłości. Istotne jest wyraźne wskazanie we wniosku charakteru prawnego dłużnika, bowiem determinuje to nie tylko określenie trybu postępowania upadłościowego, ale pozwala także na ustalenie czy dłużnikowi przysługuje zdolność upadłościowa. Omówione zostało także szczególne rozwiązanie przyjęte przez ustawodawcę w procedurze orzekania upadłości konsumenckiej, a dotyczące obligatoryjnego przeprowadzenia przez sąd z urzędu czynności procesowych związanych z zabezpieczeniem majątku dłużnika i wydaniem szeregu postanowień dowodowych.
The paper describes the course of judicial proceedings in the consumer bankruptcy declaration being the first stage of the consumer bankruptcy proceeding as compared to usual bankruptcy proceeding. It is shown that the bankruptcy proceedings applicable to natural persons may be commenced solely upon a debtor’s petition, and the filing of such a petition is not contingent upon the date at which the insolvency occurred. Having regard for the fact that consumer bankruptcy proceedings consist of nothing else but the liquidation of the estate, there is no need for a petitioner to determine the manner in which the bankruptcy proceedings are to be conducted. The explicit indication of the debtor’s legal character in the motion is substantial, regarding the fact that it consequently enables to determine the course of bankruptcy proceeding and the conclusion in the matter of whether the debtor is vested the bankruptcy capacity. The discussed issue also includes a particular solution provided by the legislator in the matter of a consumer bankruptcy’s adjudicative process, i.e. the obligatory proceedings instituted and conducted ex officio by the court and related to a pledge of estate and a delivery of evidential decisions.
