Charakter prawny instrukcji ruchu i eksploatacji

Abstract

Sektor energetyczny odgrywa kluczową rolę w gospodarce i ładzie społecznym na poziomie lokalnym i globalnym. Jego specyfika, obejmująca wysoką kapitałochłonność inwestycji, długi czas ich realizacji oraz znaczące bariery wejścia na rynek, sprzyja powstawaniu monopoli, a pełna liberalizacja sektora nie została dotychczas osiągnięta. Realizacja celów polityki energetycznej państwa, takich jak bezpieczeństwo energetyczne, rozwój konkurencji oraz ograniczanie skutków monopoli naturalnych, wymaga interwencji regulacyjnej, w tym nałożenia licznych obowiązków na operatorów systemów energetycznych oraz sprawowania nadzoru przez Prezesa URE. Jednym z kluczowych obowiązków operatorów systemów przesyłowych, dystrybucyjnych, magazynowania i skraplania gazu ziemnego jest opracowanie instrukcji ruchu i eksploatacji, sporządzanych na podstawie art. 9g ustawy – Prawo energetyczne, w procedurze konsultacyjnej i zatwierdzanych decyzją administracyjną. Instrukcje te określają warunki korzystania z infrastruktury energetycznej oraz zasady jej eksploatacji, rozwoju i obsługi użytkowników, obejmując zarówno regulacje techniczne, jak i organizacyjno-kontraktowe. Zgodnie z ustawą stanowią one część umów łączących operatorów z użytkownikami systemów. Celem rozprawy jest wykazanie, że instrukcja ruchu i eksploatacji stanowi podstawowy instrument zarządzania i użytkowania systemu energetycznego o charakterze technicznym, organizacyjnym i prawnym, współkształtujący stosunki zobowiązaniowe. Praca składa się z pięciu rozdziałów poświęconych podstawom prawnym, zakresowi obowiązku, treści, procedurze opracowania oraz obowiązkowi stosowania instrukcji, a kończy się wnioskami i postulatami de lege ferenda.

The energy sector plays a crucial role in the economy and social order at both the local and global levels. Its specific characteristics, including the capital-intensive nature of investments, long implementation periods, and significant barriers to market entry, foster the emergence of monopolies, and full liberalisation of the sector has not yet been achieved. The pursuit of state energy policy objectives, such as ensuring energy security, promoting competition, and mitigating the negative effects of natural monopolies, requires regulatory intervention, including the imposition of numerous obligations on energy system operators and regulatory oversight exercised by the President of the Energy Regulatory Office. One of the key obligations imposed on transmission, distribution, gas storage, and LNG system operators is the preparation of Polish network codes, developed pursuant to Article 9g of the Energy Law Act through a consultation procedure and approved by way of an administrative decision. These codes define the conditions for using energy infrastructure as well as the rules governing its operation, development planning, and user services, covering both technical and organisational-contractual matters. Under statutory provisions, Polish network codes form an integral part of the agreements between system operators and system users. The aim of the dissertation is to demonstrate that Polish network codes constitute a fundamental instrument for managing and using an energy system in technical, organisational, and legal terms, and that they co-shape the content of contractual relationships. The dissertation is structured into five chapters addressing the legal foundations, the subjective and objective scope of the obligation, the structure and content of the codes, the procedure for their adoption, and the obligation to apply them. The study concludes with findings relating to the stated thesis and detailed hypotheses, as well as de lege ferenda proposals.
