THE RIGHTS OF AN INDIVIDUAL IN THE HANDING OVER PROCEDURE IN THE EUROPEAN UNION
Abstract
Niniejsze opracowanie służy rozstrzygnięciu, czy za wystarczającą uznać można ochronę praw osób będących podmiotami współpracy państw członkowskich UE w sprawach karnych we wspólnej europejskiej przestrzeni prawnej, a w szczególności osób, objętych procedurą przekazania na podstawie europejskiego nakazu aresztowania (ENA). W tym kontekście uwzględnienia wymagają przede wszystkim prawa osoby pozbawionej wolności (tzn. zatrzymanego, tymczasowego aresztowanego oraz skazanego), prawo do rzetelnego i uczciwego procesu, a także inne prawa jednostki, wynikające z treści postanowień decyzji ramowej Rady UE w sprawie europejskiego nakazu aresztowania i procedury wydawania osób między państwami członkowskimi. Regulacje owej decyzji ramowej zawierają bowiem szereg gwarancji przysługujących osobie podlegającej przekazaniu w trybie ENA. Gwarancje te mają różnorodny charakter, począwszy gwarancji natury ogólnej, stojących na straży respektowania praw człowieka, poprzez gwarancje o charakterze humanitarnym, a na gwarancjach związanych bezpośrednio ze statusem osoby podlegającej przekazaniu skończywszy.
*This present paper serves to resolve the question whether the protection of the rights of persons, subjects of the EU member states, is sufficient when it comes to the cooperation of member states in criminal matters in the common European legal space. Special attention has been given to persons to whom the handing over procedure under the European Arrest Warrant (EAW) applies. In the case persons deprived of liberty (arrested, detained or convicted) their right to fair trial and other rights arising from the framework decision of the European Council on the European Arrest Warrant and the procedure of handing over persons between member states must be accounted for and observed. The EU regulations provide for a range of guarantees and rights due to a person under the EAW, from guarantees of general character that safeguard the human rights, through guarantees of humanitarian nature, to guarantees directly related to the status of the person being handed over.
