Legal instruments for eliminating barriers to territorial cooperation for development. The EU and national perspectives
Abstract
Rozprawa doktorska dotyczy podejmowania współpracy terytorialnej na rzecz rozwoju, której głównymi aktorami są struktury regionalne i lokalne. Z perspektywy unijnej poprzez dążenie do rozwoju w ramach podejmowania współpracy należy rozumieć osiąganie celów zawartych w art. 174 TFUE. Natomiast z perspektywy krajowej, należy rozumieć realizacje celów rozwojowych zawartych w ustawie z dnia 6 grudnia 2006 r. o zasadach prowadzenia polityki rozwoju. Ważną rolę w podejmowaniu współpracy terytorialnej odgrywają unijne oraz krajowe regulacje, które wyznaczają normatywne jej ramy. Jednak fundament stanowią unijne zasady prawa, formułujące reguły jej nawiązywania. Współpraca terytorialna na rzecz rozwoju jest podejmowana z wykorzystaniem zróżnicowanych unijnych oraz krajowych instrumentów prawnych. W jej ramach występują różnego rodzaju bariery, wynikające z prawa międzynarodowego, unijnego oraz krajowego. Głównym celem rozprawy było wykazanie, że działania na poziomie Unii Europejskiej służą eliminowaniu barier występujących we współpracy terytorialnej na rzecz rozwoju. W tym celu przeanalizowano instrumenty prawne w unijnym i w krajowym porządku prawnym, a także w obszarze prowadzenia polityki rozwoju.
The doctoral dissertation concerns territorial cooperation for development, the main actors of which are regional and local structures. From the EU perspective, striving for development within the framework of cooperation should be understood as achieving the goals set out in Art. 174 TFEU. However, from a national perspective, the implementation of development goals contained in the Act of December 6, 2006 on the principles of development policy should be understood. EU and national regulations play an important role in undertaking territorial cooperation and determine its normative framework. However, the foundations are the EU legal principles that formulate the rules for establishing cooperation. Territorial cooperation for development is undertaken using various EU and national legal instruments. There are various types of barriers resulting from international, EU and national law. The main aim of the dissertation was to demonstrate that activities at the European Union level serve to eliminate barriers occurring in territorial cooperation for development. For this purpose, legal instruments in the EU and national legal order were analyzed, including in the area of development policy.
