Legal aspects of farm animal protection in the agricultural production process
Abstract
Praca doktorska dotyczy prawnych aspektów ochrony zwierząt gospodarskich w procesie produkcji rolnej. Analizie został poddany status prawny tych zwierząt. w kontekście społeczno-gospodarczych i kulturowych funkcji, które pełnią. Poruszono także zagadnienie dereifikacji i humanitarnego traktowania. Szczegółowo omówiono ochronę dobrostanu zwierząt oraz kwestie związane z dopuszczalnymi prawnie warunkami, w których można prowadzić chów zwierząt gospodarskich. Ważną część pracy stanowi także temat ochrony tych zwierząt podczas transportu, a także w momencie uboju. Autorka analizuje także dopuszczalność uboju rytualnego. Dodatkowo, praca porusza kwestie ochrony zdrowia zwierząt gospodarskich, a także ich zasobów genetycznych. Wykorzystano akty prawa międzynarodowego, unijne, polskie, a w pewnym zakresie także legislacje państw obcych oraz literaturę polską i zagraniczną. Pozwoliło to na ukazanie szerokiego kontekstu prawnego. Praca postuluje potrzebę wzmocnienia prawnej ochrony zwierząt gospodarskich w procesie produkcji rolnej poprzez podniesienie standardów postępowania z nimi.
The doctoral thesis concerns the legal aspects of the protection of farm animals in the agricultural production process. The legal status of these animals was analyzed in the context of the socio-economic and cultural functions they fulfill. The issue of dereification and humane treatment was also raised. The protection of animal welfare and issues related to legally permissible conditions in which farm animals can be kept are discussed in detail. An important part of the work is also the topic of protecting these animals during transport and at the time of slaughter. The author also analyzes the acceptability of ritual slaughter. Additionally, the work discusses the issues of protecting the health of farm animals and their genetic resources. Acts of international, EU and Polish law were used, and to some extent also legislation of foreign countries as well as Polish and foreign literature. This made it possible to present a broad legal context. The work postulates the need to strengthen the legal protection of farm animals in the agricultural production process by raising the standards of their treatment.
