Abstract
The basic role of penal law raises the question of the functions of penalties. It was traditionally
perceived as a retaliatory reaction to the crime committed and with time it has a become an element
of prevention. Judges, who play a special role, shouldn’t focus exclusively on applying the
law, but in addition should educate the criminal and society.
