Item Międzynarodowa ochrona korespondentów wojennych(Wydawnictwo Naukowe WNPiD UAM w Poznaniu, 2009) Działak, JulitaIn order to improve the protection of correspondents, the journalists themselves have begun to establish organizations and institutions intended to protect the reporters, or to collect and spread information. The most respectable in this respect is the International Federation of Journalists, seated in Brussels, the largest global organization of journalists. It was established in 1926. Reporters are also aided by the organization Reporters Without Borders (RWB or Reporters sans frontières RSF) founded in 1985. On November 26, 2007 a conference was held in Geneva where the draft of an international convention on the strengthening of journalists’ protection during military conflicts and in other situations was suggested. The draft of this international Convention was subjected to global consultation.Item Cooperation between The European Union and International Organisations in the field of commercial policy(Wydawnictwo Naukowe WNPiD UAM w Poznaniu, 2009) Menkes, MarcinAutor artyku³u analizuje pewne problemy dotycz¹ce wspó³pracy Wspólnoty Europejskiej z instytucjami międzynarodowymi. Autor koncentruje siê na współpracy z ustalonymi strukturami instytucjonalnymi. Jako, że rzadko posiadają one międzynarodową osobowość prawną, współpraca tylko wyjątkowo obejmuje członkostwo w organizacji międzynarodowej. Najpierw autor analizuje trudnoœci, wobec jakich staje Wspólnota Europejska w procesie dostosowania procedur akcesyjnych do zewnętrznych struktur instytucjonalnych. W drugiej części opracowania autor podkreśla konsekwencje braku członkostwa Wspólnoty Europejskiej w takich strukturach, dotyczące zarówno tych struktur jak i państw członkowskich UE. Omówiono także pewne skutki omawianych reform konstytucyjnych.Item Realizacja programu reprywatyzacji w Republice Czeskiej i na Węgrzech po roku 1989(Wydawnictwo Naukowe WNPiD UAM w Poznaniu, 2009) Patkowski, KrzysztofThe paper discusses Czech and Hungarian ideas concerning the implementation of the reprivatization program, which are compared with Polish reprivatization programs in the conclusion. In all these countries more or less successful attempts have been undertaken to solve the problem of returning property to former owners. Similar problems have been encountered everywhere, and it has been practically impossble to return to the original status quo. In each country a majority of large industrial plants have expanded. Ater the war numerous state investments carried out which have completely altered these businesses. At the same time, he claims that democracy, and liberal democracy in particular, cannot be said to be the necessary outcome of social contract. Hobbes was the advocate of absolute monarchy, although his theory permiabsolute aristocracy as well as absolute democracy. Locke, a supporter of a limed monarchy, emphasized the principles of people’s sovereignty. Rousseau, an apologist for thel will, tended to support such the solon that it is not the people’s will but the wisest ones’ whichrulthe sciety as long as they have the people’s benefit in mind. This realization Moscow continuously pursue policy to regain its position on the international arena. In his opinion, this universal middle class is not a homogenous group. This concerns the defense of the Church’s position in public life and preventing attempts to marginalize the Church. By means of conducting its own remembrance policy the Church intends to augment the monumental aspect of collective Polish memory seeing it as an opportunity to maintain the most extensive range of influence.Item Prawa i obowiązki stron umowy licencyjnej dotyczącej wzorów przemysłowych w świetle regulacji krajowych i Unii Europejskiej(Wydawnictwo Naukowe WNPiD UAM w Poznaniu, 2009) Skrzypczak, JędrzejThe paper analyzes the rights and responsibilities of the parties of license agreements concerning industrial providd for in Polish and EU regulations. In particular, it attempts to answer the question whether the licensee’s commissioning of manufacturing activities may infringe on the license conditions. It is proposed here that such licensee conduct is covered by the extent of the license provided that the licensee is in charge of organizing the manufacturing process and solely decides about the principles, conditions and the scale of production; he retains the ownership right to the product manufactured; the product is introduced under the licensee’s own brand; the licensee actually decides about the principles under which the product is launched on the market, including the complete, independent and unlimited freedom of deciding about the commercial conditions concerning the price, markup and term of payment; and the licensee bears full responsibility for the quality of the commodity entered into the market whereas the role of the contractor is limited to the performance of technical activities related to the manufacturing of the product protected by the indial.Item Sondaże a wynik wyborów - polskie doświadczenia lat 1990 - 2005(Wydawnictwo Naukowe WNPiD UAM w Poznaniu, 2009) Rachwał, MarcinThe objective of this paper is to determine the role of opinion polls in voters’ decision making. The fundamental problem is whether the polls reflect the voters’ opinions or rather shape them. The paper also touches upon the prohibition publish the results of the polls before the elections. These considerations take into account the experience of parliamentary and presidential elections in Poland in 1990–2005.Item Ochrona prawnokarna dóbr kultury(Wydawnictwo Naukowe WNPiD UAM w Poznaniu, 2009) Sobczak, JacekUstawodawca polski, w praktyce od początku istnienia I Rzeczypospolitej aż po dzień dzisiejszy, z podziwu godną konsekwencją stoi na stanowisku, iż prawnokarna ochrona dóbr kultury winni być wydzielona i znaleźć się w ramach odrębnych ustaw stojących na straży dóbr kultury. Obowiązujące w Polsce regulacje w zakresie prawnokarnej ochrony zabytków, tak w części odnoszącej się do przestępstw, jak i do wykroczeń, spełniają wszelkie standardy określone w aktach prawa międzynarodowego. Obejmują one całościowy katalog działań mających charakter przestępstw i wykroczeń wymierzonych w substancję zabytkową.Item Ochrona dziedzictwa kultury w systemie prawnym Unii Europejskiej(Wydawnictwo Naukowe WNPiD UAM w Poznaniu, 2009) Sobczak, WitoldWspólnoty Europejskie a później Unia przez długi czas nie poświęcały szczególniejszej uwagi zarówno ochronie europejskiego dziedzictwa kultury, jak i problematyce polityki kulturalnej, pozostawiając ten obszar mniej lub bardziej świadomie systemowi Rady Europy. Kwestie dotyczące tego obszaru zostały określone dopiero w treści art. 151 TWE. Treść art. 151 TWE ogranicza działalność Unii Europejskiej w sferze kultury jedynie do działań uzupełniających i wspomagających. Przy podejmowaniu ich koniecznym jest poszanowanie różnorodności narodowej i regionalnej i podkreślanie znaczenia wspólnego dziedzictwa kulturowego Europy. Polityka kulturalna pozostaje jednak domeną państwa członkowskich. Unia winna jedynie zachęcać te państwa do współpracy, uzupełniać ich działania w zakresie wskazanym w treści art. 151. W zakresie prawa wspólnego w obszarze kultury istnieje jedynie tzw. miękkie prawo (soft law), a akty prawa wspólnotowego w postaci rozporządzeń i dyrektyw czy decyzji dotykają tej płaszczyzny tylko wówczas, gdy obszar kultury przenika się z obszarami regulowanymi przez prawo wspólnotowe, takimi jak przepływ osób, towarów i ochrona konkurencji.Item Tożsamość Białorusinów(Wydawnictwo Naukowe WNPiD UAM w Poznaniu, 2009) Kakareko, KseniaTożsamość białoruska wydaje się być nie tyle tożsamością narodową, co tożsamością regionalną. Oczywiście proces kształtowania świadomości narodowej nie został zakończony i wydaje się on przebiegać odmiennie na obszarze Białorusi zachodniej, zwłaszcza na Grodzieńszczyźnie, inaczej w Mińsku, a jeszcze inaczej we wschodniej Białorusi. Świadectwem odrębności Białorusinów od Rosjan w tej sytuacji stają się jedynie zwyczaje i pieśni ludowe, które powoli, wraz ze starszym pokoleniem, odchodzą w przeszłość, jawiąc się jedynie jako ciekawostka etnograficzna, z małym zresztą zainteresowaniem odbierana przez miejscową publiczność.
