    Postępowanie w przedmiocie zmiany gleboznawczej klasyfikacji gruntów w świetle rozporządzenia Rady Ministrów z 12 września 2012 r.

    The subject of the paper is a proceeding with regard a soil-type-based classification of land, that is a proceeding which pursuant to article 2 point 12 of the Act of 17 May 1989: Geodetic and Cartographic Law provides for classification of soils dependent on their productivity based on soil genetic characteristics. The author concludes that the decree of the Council of Ministers of 12 September 2012 has properly regulated the proceedings in the above matter. In particular, elimination of the requirement to refer to the earlier decree of the Council of 4 June 1956 applicable to the same proceeding, is a positive development. A shortcoming though, is the fact that the recent decree lacks details regulating the principles according to which soil classifying entities should work.

    Wykonywanie zarządu nad gospodarstwem rolnym ustanowionego dla zabezpieczenia roszczeń w postępowaniu cywilnym

    Article 747 of the Code of Civil Procedure provides for securing monetary claims by way of establishing enforced management of an agricultural holding or its part. The detailed manner of establishing such security is provided in article 7524 of the same Code. The paper is an attempt of a comprehensive analysis of the issue to find solutions to many practical problems. As the analysis shows, although establishing a charge to secure claims seems justified and practical, its form described in the paper raises certain doubts.

    Nowa niemiecka ustawa o strukturze rynku rolnego z 2013 r. - rolnicze organizacje producentów i związki branżowe w prawie niemieckim

    In 2012 the European Union regulated for the first time the issue of recognition of producers organisations, associations and unions by the state. Thus a question arises how German law on the structure of the agricultural market should be harmonised with the New EU regulation. The author analyses the new situation and concludes that the introduced instrument of recognition of agricultural organisations and related to it abolition of the cartel agreement prohibition combined with financial support offered to those organisations is adequate to enhance the mutual assistance system existing among agricultural holdings and to improve the dialogue along the food chain. However, its role is doubtful, particularly when it comes to a price crisis. Regardless of how the CAP negotiations end, member states will soon have to face the new challenges identified in the paper.

    Procedura wprowadzenia do obrotu organizmów genetycznie zmodyfikowanych w UE i USA

    The selection of legal orders presented in this paper is not accidental as they are an example of two different approaches to the newest biotechnological achievements in the food and agriculture sector. The restrictive model that has been so far applicable in the European Union with regards genetically modified organisms stands in direct contrast to the liberal American model. As can be seen from the analysis of the two, both approaches reflect, to a certain extent, the position enjoyed by respective lobbying groups in the UE and the US. A substantial part of the paper focuses on the prudence and equality principles. The regulation on launching GMOs on the market seems to be dependent on which one of these two constitutes the axiological foundation of the regulation.

    Żywienie dzieci. Zarys problematyki cywilnoprawnej

    The subject of this paper is proper child nutrition in light of civil law, and resulting from it tasks and duties of the adults. Particular obligations of individual members of the society, and in particular parents, family members, medical professionals, teachers and educators, are discussed. Child nutrition is analysed in the context of parental authority and responsibility of care for a minor. The results of the conducted analysis show that parents are for and foremost obliged the fulfil the duty due care arising from child nutrition obligation while other persons are obliged to play a supportive role in fulfilling the task. The paper ends with a brief discussion of the liability for breaching the duty of proper nutrition of children.

    Systemy jakości produktów rolnych i środków spożywczych w świetle nowej regulacji prawnej

    The subject of this paper is quality schemes for agricultural products and foodstuffs in light of Regulation (EU) No 11/51/2012 of the European Parliament and the Council of 21 November 2012. Although agricultural products quality may be approached in different ways, no definition of the concept has been provided in the Regulation. The approach to the quality of agricultural products and foodstuffs employed in the Regulation, on the one hand, is a continuation and strengthening of the earlier views on quality, but it also, on the other hand, combines quality schemes with consumer information, support extended to agricultural producer and fair competition. The legal solutions proposed in the Regulation have been divided into mandatory and optional, which may lead to a conflict between quality and high quality, since quality becomes a resultant outcome of the features referred to in legal acts rather than an added value.

    Pojęcie zabudowy zagrodowej na tle przepisów o zagospodarowaniu przestrzennym

    The aim of this paper is an analysis of the concept ‘farm building’ in light of article 41 clause 4 of the Act on Planning and Spatial Development and clarification of certain specific issues. Different interpretations of the same concept are presented, followed by rather impossible to accept consequences of such interpretations grounded in the regulations of construction law and agricultural law. Further, relationships between certain legal categories referred to in the Act, such as an agricultural holding, a dwelling plot, or a barnyard are discussed with an attempt to decide whether a dwelling house alone, if connected with an agricultural holding, may be treated in the same way as a farm building. The importance of the size factor in determining different categories of building permits and conditions has been also noted. Finally, the manner of determining land development conditions for small objects erected in small agricultural holdings is presented.

    Prawne pojęcie producenta rolnego według ustawy o krajowym systemie ewidencji producentów, ewidencji gospodarstw rolnych oraz ewidencji wniosków o przyznanie płatności w świetle orzecznictwa

    The aim of this paper is to define the concept of an agricultural producer that exists in the Act on the state system of registering producers, agricultural holdings and registering applications for subsidies, and to analyse selected judicial decisions applicable to the use of that concept in practice. The deliberations commence with an analysis of certain general issues such as: a spouse as an agricultural producer, an applicant as an agricultural producer, and an agricultural producer as a group of persons. Further, issues related to the striking off the identification number are presented and discussed. The paper concludes with an opinion that excluding an agricultural producer who is a spouse of another agricultural producer from the system of support dedicated to agricultural producers is unjustified, and ends with a postulate that the law on the state system of registering agricultural producers, agricultural holdings, and registering applications for subsidies needs to be amended.

    Prawne instrumenty zarządzania ryzykiem w rolnictwie

    This paper deals with the methods of reducing risk management that accompanies the production process in agriculture. Most of the instruments used for managing risk, despite the fact that they are based on economic mechanisms, are put in a certain legal framework. Their efficiency is largely based on the level of farmers’ knowledge and awareness. There are many ways in which risk may be managed. Every agricultural holding should have certain risk management instruments implemented. An important role play so-called risk sharing instruments, such as term contracts, mutual investment funds, cooperation between agricultural producers groups and the like. Although the supportive role of the state is invaluable when farmers’ income is at risk, the state should come in aid only when all other risk management instruments implemented by the farmer have proved inefficient
