    Problematyka niewypłacalności przedsiębiorcy rolnego we Włoszech a instytucje prawa upadłościowego

    Under the recent amendments to Italian insolvency law, two of its institutions may be used in respect of agricultural entrepreneurs. They are: a debt restructuring agreement and an agreement with tax authorities. Familiarisation with both will perhaps be inspiring for Polish legislators who may then wish to consider extending insolvency regulations on debt restructuring on individual agricultural entrepreneurs. Such a solution would be similar to a composition agreement with one exception: it would require a debt repayment proposal agreed by at least 60% of the creditors and the debtor to be submitted to court for approval. The proposal would have to account for guaranteed repayment all creditors, including those who were not a party to the agreement as well.

    Wymogi higieniczno-sanitarne w sprzedaży bezpośredniej produktów rolnych w prawie włoskim

    This paper aims to evaluate the use of discretionary powers in Italian legislation relating to the determination of national hygiene and sanitation measures in direct sales of agricultural products. The task undertaken was not only to determine whether national provisions have been enforced, but also to find out whether their adoption facilitates direct sales, while ensuring public health safety. The paper presents domestic measures available under Italian legislation on food sanitation applicable to different forms of direct sales. As can be seen, wherever allowed, Italian legislators introduced derogations from the EU legal provisions, especially with regards direct sales of small quantities produced according to traditional methods, also in order to adapt sanitation requirements with the local environments specifics (agro-tourism). At the same time, however, efforts have been made to ensure food safety in line with the EU recommendations.

    Odpowiedzialność za wprowadzenie konsumentów w błąd przez sugerowanie szczególnych właściwości żywności

    There is no efficient measure available in Polish food law which would prevent consumers from being misled by information suggesting that a certain product has specific properties (while all other products of that kind also have them). The present situation when heavy penalties for distorting the picture of a product (to the result similar to that of fraudulent misrepresentation) may be avoided, even seems to encourage such manipulation practices. The only penalty that may be administered is a fine for marketing a product of commercial quality which does not match the description. This sanction, however, is insufficiently severe to act as a deterrent. Therefore it is postulated that the current regulations should be modified to account for situations in which customers are misled by true information but presented unfairly.

    Prawne aspekty nanotechnologii w produkcji żywności i materiałów przeznaczonych do kontaktu z żywnością

    This paper discusses selected legal aspects of nanotechnology in the production of food and materials intended to come in contact with food, and analyses statutory regulations on potential risk assessment in the event of using nanotechnology in new foods and materials for contact with food, and acts regulating chemical substances and their mixtures. It seems that Regulation No 1169/2011 which contains a detailed definition of nanomaterials is the most suited for reference when the above issues are discussed. From the point of view of the obligation of informing customers of the presence of nanoparticles in food, the solutions of the Regulation are satisfactory. The paper ends with a conclusion that the existing regulation accounts for the need to assess the possible risk of using nanotechnology, although the scope and level of detail of its assessment is not uniform.

    Oznaczenie pochodzenia geograficznego a oliwa z oliwek

    This paper describes how the problem of identification of geographical origin has been solved on the olive oil market. Olive oil is of capital economic importance for Spain, and especially for its province of Jaén. Reading Article 4 of Regulation (EU) No 29/2012, in particular, allows to conclude that designations of the origin on labels are restricted to olive oil first press, regardless whether it is extra virgin olive oil first press or simply olive oil first press. It is not possible to give information on the other two categories: olive oil or olive pomace oil on the label.

    Karnoprocesowa ochrona lasu w świetle kompetencji Straży Leśnej

    This paper discusses selected issues related to forest protection as determined in the Law on Forests of 28 September 1991. It focuses on the powers of Forest Guards regarding enforcement of sanctions under criminal procedural law, and the confrontation of statutory solutions of these issues with their practical application. In order to emphasise the importance of the function of forest guards in forest protection, their powers have been compared to those vested in forest rangers and wild life guards in national parks. The conclusions indicate that Forest Guards constitute an important element in forest protection, having a range of competences and powers enabling them to enforce criminal sanctions and other measures provided by relevant laws. It is not, however, only legal regulations which determine the level of forest protection. This depends directly upon proper funding, capable of enabling adequate realisation of forest protection.

    Nowe zasady przyznawania emerytur rolniczych

    This paper aims to evaluate the new principles of granting agricultural pensions as a result of the reform of the pension system in Poland. Issues such as equalising the retirement age for men and women, raising it at the same time for both sexes, or pension privileges of farmers and the possibility of introducing a uniform pension system for all have been discussed. It is concluded that neither raising nor equalising retirement age will answer the need for providing agricultural producers past their active working life adequate security. The high retirement age falls short when it comes to the protective function of agricultural pension security and it also poses a threat to the generation change in the membership composition in family holdings. The pension reforms carried out so far does not account for the ‘insuring’ character of social insurance nor does it provide adequate protection of the insured. A new model for agricultural producers must be developed, to take into account the essence and function of agricultural social insurance.

    Produkcja energii z biomasy rolniczej a pojęcie działalności rolniczej w prawie włoskim i francuskim

    The concept of agricultural production in Italy as well as in France has been relatively broad and it includes the use of biomass for energy production, which largely originates from own agricultural production. The introduction of a modern definition of agricultural production that includes utilisation of certain forms of biomass for energy purposes helps to eliminate potential concerns when it comes to situation like qualification of agricultural land on which agricultural bio-gas plants are located, or recognition of such plants or bioenergy equipment as belonging to a given agricultural farm. The legal regulations analysed in the paper account for the concept of multifunctional agriculture and permit agricultural producers to maintain their privileged status when they engage in a production of energy from renewable sources.Challenges of counteracting climate change in order to maintain territorial balance constitute the basic premises for integrating ‘new’ forms of agricultural activity with the traditionally understood categories existing in agricultural law, including the concept of agricultural activity.

    Prawne aspekty zakładania i prowadzenia działalności przez wstępnie uznane grupy oraz organizacje producentów owoców i warzyw

    This paper aims to evaluate the legal principles of establishing and running preliminarily recognised groups and organisations of fruit and vegetable producers after the amendments of the EU and Polish regulations. Among others, the approval principles of preliminary recognition (pre-recognition) and realisation of the recognition plans have been presented, followed by an analysis of membership agreements and the procedure of acquiring a status of a recognised organisation of fruit and vegetable producers. The supervision of those organisations by the province marshal as well as the financing of their activities using EU funds have been described. The paper ends with a conclusion that activities of preliminarily recognised groups and organisations of fruit and vegetable producers have been conducive to the development of the fruit and vegetable market in Poland. However, in order to make them even more efficient, the establishment procedures and the principles governing the running of groups and organisations of fruit and vegetable producers should be simplified, and legal instruments guaranteeing their greater stability introduced.
